1. Acceptance of Terms
By accessing or using the Gehtsoft Form Assistant service ("Service"), including the embeddable chat widget, API endpoints, organizer dashboard, and associated documentation, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
Gehtsoft Form Assistant is an AI-powered chat widget that provides real-time contextual guidance to users filling out forms. The Service includes:
- An embeddable JavaScript widget for web pages and PDF viewers
- A backend API that processes user questions using large language model (LLM) technology
- An organizer dashboard for managing webinars, meetings, and AI assistant configuration
- A participant interface for webinar and meeting chat
3. Accounts and Access
3.1 API Key Access. Clients integrate the Service using an API key provided by Gehtsoft. Each API key represents a tenant with its own configuration, usage limits, and data isolation.
3.2 Organizer Accounts. Organizers register with a username, email, and password. Organizers are responsible for maintaining the confidentiality of their credentials.
3.3 Participant Access. Webinar participants may be required to provide an email address for verification purposes. Participation implies acceptance of these Terms and the Privacy Policy.
4. Acceptable Use
You agree not to:
- Use the Service to process, store, or transmit data in violation of any applicable law or regulation
- Attempt to circumvent rate limits, authentication, or security measures
- Submit questions or content that is illegal, harmful, or violates third-party rights
- Use the Service to collect or harvest personal data of other users
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use the Service for automated or bot-driven queries
5. Data Processing
5.1 Chat Data. When a user interacts with the Form Assistant widget, the Service processes: the user's question, the name of the selected form field, the current value of the selected field (transiently, not persisted), and the conversation history. This data is used to generate AI responses and is stored as chat transcripts.
5.2 Third-Party AI Processing. User questions and form context are sent to a third-party large language model provider (currently OpenAI) for response generation. By using the Service, you acknowledge and consent to this data transfer. See our Privacy Policy for details.
5.3 Data Retention. Chat transcripts and meeting messages are retained according to the retention policy configured for your tenant. Default retention is indefinite unless automatic cleanup is enabled by the administrator.
6. Intellectual Property
The Service, including all software, documentation, and design, is the intellectual property of Gehtsoft USA LLC. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
The AI-generated responses provided by the Service are generated for informational guidance purposes only and do not constitute professional, legal, tax, or financial advice.
7. Disclaimers
7.1 AI Accuracy. The Service uses AI technology that may produce inaccurate, incomplete, or outdated responses. Gehtsoft does not warrant the accuracy of AI-generated content. Users should verify all information independently and consult qualified professionals for official guidance.
7.2 No Professional Advice. Form Assistant provides general guidance only. It is not a substitute for professional tax, legal, medical, or financial advice.
7.3 Service Availability. The Service is provided "as is" and "as available." Gehtsoft does not guarantee uninterrupted or error-free operation.
8. Limitation of Liability
To the maximum extent permitted by law, Gehtsoft USA LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to damages arising from incorrect AI responses, data loss, or service interruptions.
9. Indemnification
You agree to indemnify and hold harmless Gehtsoft USA LLC from any claims, losses, or damages arising from your use of the Service, your violation of these Terms, or your violation of any applicable law.
10. Changes to Terms
Gehtsoft reserves the right to modify these Terms at any time. Material changes will be communicated via the Service interface or email. Continued use after changes constitutes acceptance of the updated Terms.
11. Termination
Gehtsoft may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases, but provisions regarding liability, indemnification, and intellectual property survive.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
